General Terms and Conditions

1. General
The following General Terms and Conditions apply to the business relationship between the Fürnkranz Winery (Obritz 323, 2061 Hadres, Austria) and the customer, as amended from time to time. By placing an order, the customer agrees to the General Terms and Conditions.

2. Order/Conclusion of Contract
The presentation of products in the online shop does not constitute a binding offer on the part of Weingut Fürnkranz. Only by placing an order does the customer make a binding offer to conclude a purchase contract. To do so, the customer places a minimum quantity of 6 bottles (order only possible in increments of 6) in the shopping basket, provides the billing and delivery address, agrees to the General Terms and Conditions, the right of revocation and the data protection provisions, and undertakes to settle the invoice (including other fees and costs) immediately.
By placing an order, the customer further confirms that he/she or the recipient of the goods is at least 18 years of age.

3. Payment
Payment shall be made by means of “purchase on account”. The invoice is due immediately after issue. The goods will not be delivered/shipped until the invoice has been settled.
If the customer is in arrears with payment, interest on arrears of 4% will be charged.

3. Prices and dispatch / delivery
The prices listed are gross prices excluding shipping costs, including all taxes and duties. For deliveries outside of Austria, additional customs duties/charges may be incurred, which are to be borne by the customer.
Shipping or delivery is made to the specified delivery address and is free of charge within the following countries from 6 bouteille bottles: Austria, Germany, Czech Republic, Hungary, Belgium, Netherlands and Luxembourg.
Delivery costs outside the countries listed above will be announced on request (e-mail to: info@vegan-wein.at).
Vouchers will be sent by e-mail in the form of a PDF to the e-mail address provided after payment of the invoice.
Vouchers can be redeemed directly at Weingut Fürnkranz or in the webshop before the order is completed, whereby the entire voucher value must be redeemed within one order. If the order value is less than the voucher value, the outstanding amount of the voucher will be forfeited.

4. Reservation of proprietary rights
The Fürnkranz Winery reserves the right of ownership of the delivered goods vis-à-vis consumers until full payment of the purchase price owed including ancillary charges.
With regard to companies, the Fürnkranz Winery retains ownership of the goods delivered until all claims arising from the current business relationship have been settled in full.

5. Right of revocation
You have the right to revoke this contract within fourteen days without giving any reason.
The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods.
In order to exercise your right of withdrawal, you must inform us (Gerald Fürnkranz, Obritz 323, 2061 Hadres, Austria, info@vegan-wein.at) of your decision to withdraw from this contract by means of a clear written declaration (e.g. by e-mail or a letter sent by post).
In order to comply with the revocation period, the notification of the exercise of the right of revocation must be sent before the expiry of the revocation period.

Consequences of the revocation
If the contract is revoked, all payments made, including any delivery costs, must be refunded immediately, at the latest within 14 days of receipt of the notice of revocation.
For this repayment, the same means of payment will be used that was used for the original transaction, unless expressly agreed otherwise with you; in no case will fees be charged because of this repayment.
The repayment may be refused until the goods are returned or proof is received that the goods have already been returned, whichever is the earlier.
The goods must be returned or handed over without delay and in any case no later than fourteen days from the day on which you have informed us of the cancellation of this contract. The deadline is met if the goods are dispatched before the end of the fourteen-day period.
The direct costs of returning the goods shall be borne by the customer.

6 Warranty
The customer must check the condition of the goods immediately after receipt. If the goods are damaged or incomplete, the customer must report this immediately in writing within 7 days, stating the invoice number, a brief description of the defect and attaching a copy of the delivery note, otherwise his claims will be lost.
A warranty claim is limited to the purchase price of the delivered and defective goods.
Any warranty is excluded after tasting or consumption.

7. Liability
In the event of slight negligence, any liability on the part of the Fürnkranz Winery is excluded. This exclusion of liability does not apply in the case of injury to life, body or health.

8. Data protection
Information on the type and scope of the collection, processing and use of personal data can be found in the data protection declaration.

9 Jurisdiction
The concluded contract is exclusively subject to Austrian law. The place of jurisdiction is the court locally and factually responsible for the location of Weingut Fürnkranz.

10. Final clause
Should individual provisions of these General Terms and Conditions be or become invalid or unenforceable in whole or in part, this shall not affect the validity of the remaining provisions.
